General Terms and Conditions of Business

Preamble

Foodsteps is a small business from the “Lycée Classique de Diekirch”. The small business was created in the squad of the non-profit “Jonk Entrepreneuren Luxembourg”. This is a school project for an unlimited period of time.

A trail consists of an unaccompanied walk/hike in the city or in the countryside. By means of riddles respectively their solution, the participant/customer finds the different stops and restaurants. There the customer receives a meal or an experience at each stop.

The present GTC regulate the contractual rights and obligations between the small-business Foodsteps and the participants/customers of a trail.

Terms

  • Provider: Mini-Enterprise Foodsteps – 32, Avenue de la Gare L-9233 Diekirch
  • Partner businesses: shop/restaurant/etc. Provides a service for the participants on behalf of the provider.
  • Tour: Unaccompanied tours in different cities and regions. A puzzle team can independently look for the next partner company where he then gets something to eat, drink or experience. Starting point: According to the description of the tour.
  • Starting time: You can start a tour independently at any time within a time window from the starting point, given in the description of the trail.
  • Participant/Customer: Person, who purchased a ticket. You can complete the tour alone or in puzzle teams.
  • Puzzle team: A team of several people trying to solve the puzzle together and find the next partner company.
  • Ticket: Purchased Ticket that entitles the participant/customer to do the tour independently. With the ticket, they receive a speciality, something to eat or drink, or an experience from a partner company.

Groups of more than 8 people should contact Foodsteps to ensure a better flow of the activity.

2. Conclusion of contract

2.1 Offer

The Provider offers its services online on its website.

2.2 Purchase

By clicking on the “Buy” button on the website, the self-organized group bindingly purchases one or more tickets. The contract is concluded when the provider sends an order confirmation by e-mail and subsequently the tickets to the specified shipping address.

With the purchase of a ticket, the customers unconditionally accept the prices shown online and the GTC of the provider.

2.3 Payment

Customers pay for tickets online by credit card or Paypal and in principle receive all documents by mail within 48h.

3. Contract changes

Tickets that have been delivered cannot be cancelled. Tickets are valid for 12 months from the date of purchase. Within these 12 months, the customer can complete the trail on their own.

Overpurchased tickets will not be refunded. As the tickets are transferable, people who are unable to complete the trail can do so at a later date without notifying the provider.

4. Range of services

The provider offers various individual services with the trail. The trails are constantly being improved, which is why there is no claim to continuity of the individual services. The provider reserves the right to adjust the offer on the website, even at short notice.
The service catalogue of the provider includes the following individual services:

  • Usage of the tour with multiple puzzles
  • Information services to the partner companies for registered groups
  • Distribution of specialities, drinks or snacks by the partner companies according to the number of tickets, or an experience
  • Distribution of surprise packages

The tickets are to be carried by the participants on the day of the activity, on paper or digitally. The vouchers are to be handed over to the respective partner companies, which write down the number of the vouchers so that they can only be used once.

5. Warranty

The trail is a scavenger hunt, which takes place mainly in the open air. There is no right to sit or stay. Individual partner businesses can offer seating, rest or purchase opportunities on their own responsibility.
The provider has taken into account the opening hours of the partner establishments as far as possible and set the starting times accordingly. Despite regular checking of the trails, it is possible that individual partner establishments may not be open for a short period of time. In this case, the trail can be operated at another time.

6. Conditions of participation

6.1 Requirements for the participants

Participants must be able to complete a walk/hike in the city or countryside. Average orientation skills are required for this. No special local or regional knowledge is required. If necessary, the participant can help himself with a city map or other aids.
The trails are specifically designed for children. Children may only participate if accompanied by their parents or a guardian who must be at least 18 years old. In each puzzle team, there must be at least one person with a minimum age of 18 years.

6.2 Minimum equipment of the participants

No minimum equipment is required to use a trail. However, it is recommended to carry:

  • At least one smartphone per puzzle team that is ready to receive and transmit, with any usage fees to be paid by the participants
  • One writing utensil per puzzle team
  • For the completion of the trails, leisure clothing and footwear that are suitable for the weather and season.

7. Liability and insurance

Participants complete the trails at their own risk. Insurance is the responsibility of the individual participants.
The provider assumes no liability for direct or indirect personal injury or property damage, even if they are due to the use of a trail or at a partner operation.
The exclusion of liability also applies in case of the illegal or negligent action of a partner company or an auxiliary person of a partner company. Something else applies only in the case of an illegal act or gross negligence of the provider itself. The Provider shall not be liable for the third-party services of the partner companies.

8. Data protection

When tickets are purchased, data is collected, stored and processed for order processing. When visiting the Internet offer the provider, among other things, the IP address currently used by the phone, tablet, computer or similar device, the date and time, the browser type and operating system of the computer and the pages viewed are logged. However, it is not possible and not intended to draw conclusions about personal data.
Personal data provided, for example, when placing an order or by e-mail (e.g. name and contact details) are only processed for correspondence with the customer and only for the purpose for which the data were provided. Personal data will only be disclosed to third parties to the extent necessary for the fulfilment of the business purpose. Data may also be passed on if there is a legal obligation to do so or if the customer has expressly consented to this.

9. Newsletter

With the order, an inquiry or a contact the customer gives his consent that the supplier can send them their electronic newsletter via e-mail. This newsletter can be cancelled at any time, free of charge with a mouse click via a corresponding web link in each e-mail sent.

10. Copyright

The copyrights and all other rights to the trails, departure and puzzle documents, pictures and texts of the provider remain in any case with the provider.
Any kind of copying, duplication, passing on and publication of the data or documents is not permitted, neither in electronic nor in a non-electronic form.

11. Other General Provisions

The provider reserves the right to change these terms and conditions at any time and without notice. In each case, the version that can be viewed on the website at the time of the conclusion of the contract and accepted prior to the order shall apply.
